1. Acceptance of Terms

Welcome to Termishield Pest Control (“Termishield,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website located at www.termishieldpestcontrol.com (the “Site”) and any pest control, termite control, wildlife control, or related services (the “Services”) provided by Termishield Termite and Pest Protection LLC, a company organized under the laws of the State of Indiana.

By accessing the Site, submitting a form, requesting a quote, or engaging Termishield for Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or engage our Services.

2. Description of Services

Termishield provides residential and commercial pest management services, including but not limited to general pest control, termite control, bed bug control, rodent control, wildlife control, and related inspection services, in Indiana, Michigan, and surrounding service areas. Specific services, pricing, and scope of work will be described in your individual service agreement, quote, or invoice, which supplements these Terms.

3. Service Guarantees and Limitations

3.1 Satisfaction Guarantee. Termishield offers a satisfaction guarantee on covered services as described at the time of service or in your service agreement. Free re-treatments under this guarantee are limited to the pests and conditions covered under your specific service plan and are subject to the terms disclosed to you at sign-up.

3.2 No Guarantee Against All Infestation. Pest, wildlife, and insect activity is affected by environmental conditions outside Termishield’s control (weather, neighboring properties, construction, landscaping, etc.). Except as expressly stated in a written guarantee applicable to your service plan, Termishield does not guarantee complete elimination or permanent absence of pests.

3.3 Termite Services. Termite treatment plans, if applicable, are governed by a separate termite service agreement/warranty document that specifies covered structures, retreatment terms, and any damage repair provisions.

3.4 Multi-Visit Treatments. Certain pest issues (including bed bugs) often require multiple treatments for full effectiveness. Termishield does not guarantee elimination after a single visit unless expressly stated in your service agreement.

3.5 Wildlife and Regulated Species. Removal or exclusion of certain wildlife species (e.g., bats, some birds) is regulated by Indiana and/or Michigan state wildlife agencies. Termishield performs such services in accordance with applicable state and federal law and licensing requirements.

4. Recurring Service Plans and Billing

4.1 Customers enrolled in a recurring service plan (e.g., Shield Advantage, Shield Premier, Shield Premier Plus) authorize Termishield to bill the payment method on file on a recurring (e.g., monthly or quarterly) basis until the plan is cancelled in accordance with Section 4.3.

4.2 Pricing for recurring plans is disclosed at sign-up. Termishield will provide [30] days’ notice of any price change to recurring plan customers.

4.3 Cancellation. Customers may cancel a recurring service plan according to their service agreements/contracts by contacting Termishield at (574) 243-4020 or callthepros@termishield.org.

4.4 Missed or declined payments may result in suspension of scheduled services until payment is resolved.

5. Customer Responsibilities

You agree to:

• Provide accurate contact, property, and payment information;
• Provide safe and reasonable access to the property for scheduled services;
• Disclose known hazards, sensitivities, pets, small children, or health conditions relevant to treatment application;
• Follow any pre-treatment or post-treatment instructions provided by our technicians (e.g., re-entry times, ventilation, food storage).

Termishield is not responsible for effects resulting from failure to disclose relevant property or health information, or failure to follow provided instructions.

6. Website Use

6.1 The Site and its content (text, graphics, logos, images) are owned by or licensed to Termishield and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute Site content without written permission.

6.2 The Site is provided “as is.” While we try to keep information current and accurate, Termishield makes no warranty that Site content (including service descriptions, pricing, or blog/educational content) is complete, current, or error-free. Educational content on the Site (e.g., blog posts) is for general informational purposes only and is not a substitute for a professional inspection or treatment recommendation specific to your property.

6.3 You may not use the Site to submit false information, attempt unauthorized access to our systems, or interfere with Site operation.

7. Communications Consent (SMS, Calls, Email)

By submitting a form on the Site, requesting service, or providing your phone number or email address, you consent to be contacted by Termishield via phone, text message (SMS), and email regarding your quote request, scheduled services, appointment reminders, and account-related updates, in accordance with our [Privacy Policy] and applicable SMS consent disclosures presented at the point of collection. Message and data rates may apply. Consent to receive marketing communications is not a condition of purchasing Services. You may opt out of SMS communications at any time by replying STOP, and of marketing emails via the unsubscribe link.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Termishield’s total liability for any claim arising from the Site or Services shall not exceed the amount paid by you for the specific service giving rise to the claim. Termishield is not liable for indirect, incidental, consequential, or punitive damages, except where such limitation is not permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Termishield, its owners, employees, and technicians from claims, damages, or expenses arising from your breach of these Terms, misuse of the Site, or failure to disclose information required under Section 5.

10. Insurance and Licensing

Termishield is licensed to perform structural pest and termite control services in the State of Indiana and Michigan. License number(s): [INSERT LICENSE NUMBER(S)]. Termishield maintains applicable insurance coverage.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles.

12. Changes to These Terms

Termishield may update these Terms from time to time. Updates will be posted on this page with a revised “Last Updated” date. Continued use of the Site or Services after changes are posted constitutes acceptance of the updated Terms.
